2. Agreement to these terms
By accessing or using the Site, you agree to these Terms of Service. If you do not agree, please do not use the Site.
We may update these Terms from time to time. The version in force is the one published on this page, and the date above tells you when it changed. 3. These Terms cover the website, not our client work
These Terms govern your use of the Site only.
If you engage Successful Seller for agency services, that engagement is governed by a separate written services agreement between us. Where anything in these Terms conflicts with that signed agreement, the signed agreement takes precedence in respect of the services it covers. Nothing on this Site, including any description of our services, methodology, pricing, or results, forms part of that agreement or creates an offer capable of acceptance.
4. Permitted use
You may use the Site for lawful purposes and to learn about our services.
You agree not to use the Site in any way that breaches applicable law; attempt to gain unauthorised access to the Site, its servers, or any connected system; introduce malware or other harmful material; scrape, harvest, or systematically extract content or data without our written consent; use automated means to place unreasonable load on our infrastructure; reproduce or redistribute our content other than as permitted in section 5; or submit false information, or another person’s information without their authority, through any form on the Site.
We may suspend or withdraw access to the Site, in whole or in part, without notice, where we reasonably consider it necessary.
5. Intellectual property
All content on the Site, including text, graphics, logos, the Successful Seller name, the STOIC Method framework and its associated materials, case studies, audit materials, and the selection and arrangement of all of it, is owned by Successful Seller or licensed to us, and is protected by Canadian and international copyright and trademark law.
You may view, download, and print Site content for your own personal or internal business use. You may not otherwise copy, adapt, publish, distribute, or commercially exploit it without our prior written consent. Nothing on the Site transfers any ownership right or licence to you beyond what is expressly set out here.
6. The free listing audit and other free resources
We offer a free listing audit and other free resources through the Site. These are provided for general information. They are prepared on limited information, they are not tailored professional advice, and they do not create a client relationship between us. You should not act on them alone, and any figures, benchmarks, or observations are estimates rather than guarantees. We may decline to provide, or may discontinue, any free resource at any time.
7. Case studies, results, and testimonials
The Site describes results achieved for specific clients and includes testimonials from them.
Past results are not a guarantee or prediction of future results. Outcomes on Amazon depend on many factors outside our control, including your product, pricing, inventory, competition, category dynamics, and changes to Amazon’s own policies and algorithms. Nothing on this Site is a promise, warranty, or representation that you will achieve any particular result, revenue figure, or growth rate.

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any liability that cannot be limited or excluded under applicable law.
Subject to that, and to the fullest extent permitted by law, we will not be liable to you for any indirect, incidental, special, consequential, exemplary, or punitive loss, or for any loss of profits, revenue, business, goodwill, opportunity, data, or anticipated savings, however arising and whether or not foreseeable. Our total aggregate liability to you arising out of or in connection with your use of the Site, in contract, tort including negligence, breach of statutory duty, or otherwise, will not exceed one hundred Canadian dollars (CAD $100).

14. Governing law and jurisdiction
These Terms, and any dispute or claim arising out of or in connection with them or the Site, including non-contractual disputes or claims, are governed by the laws of the Province of Alberta and the federal laws of Canada applicable in it.
You and we agree that the courts of the Province of Alberta have exclusive jurisdiction, except that we retain the right to bring proceedings in the courts of the country in which you are resident where required. If you are a consumer resident outside Canada, you may be entitled to the protection of mandatory provisions of the law of your country of residence, and nothing in this section deprives you of that protection.
15. General
If any provision of these Terms is found unenforceable, the remaining provisions continue in force. If we do not enforce a right, that is not a waiver of it. These Terms, together with the Privacy Policy, are the entire agreement between us in relation to your use of the Site. We may assign or transfer our rights and obligations under these Terms; you may not without our written consent. No one other than you and us has any right to enforce these Terms.
